retreat waiver

by booking a retreat with Jess Learoyd Yoga, you confirm that you have read, understand and agree to the following declaration/waiver,

your health

I understand it is my responsibility to let Jess Learoyd Yoga (jess learoyd) know if I have any injuries and to be mindful at all times of my own body’s capability during retreats. I understand that I am voluntarily participating in the yoga practice and participating at my own risk. I understand that yoga includes physical movements and I recognise this may be strenuous and may cause physical injury, I am fully aware of the risks involved. If I experience any pain or discomfort, I will listen to my body, discontinue the practice, and ask for support from the instructor. I assume full responsibility for any and all damages, which may incur through participation.

I ensure that I am fit and well enough to participate in any retreat that I book, and I will at all times be responsible for my own state of health, physical condition and wellbeing. If I have any concerns about my fitness or health, I agree will seek appropriate medical advice from my GP, Physiotherapist or other relevant professional medical or other adviser and obtain their written consent where necessary before attending. Advice provided by Jess Learoyd Yoga at no time constitutes medical advice and is not a substitute for advice provided by a medical professional.

If I am pregnant, become pregnant or I am post-natal or post-surgical, I verify that I have my physician's approval to participate. I also affirm that I alone am responsible to decide whether to practice yoga and participation is fully at my own risk and that of my unborn child/children.

I know that whilst all measures are taken to ensure a high standard of health and safety, sometimes we maybe situated in the countryside and other places where the land is uneven and I know Jess Learoyd Yoga and hosting venue shall not be responsible for any injuries caused by uneven terrain.

our liability to you

We accept responsibility for ensuring that the retreats are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.

We do not accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond our control.

We are not liable for any injuries you may incur. All the exercise classes and all activities, workshops, spa treatments, and anything else is undertaken at your own risk. We are not liable for any medical or psychiatric conditions, which may develop during or subsequent to the retreat. We are not liable for loss of, or damage to, your personal property.

In further consideration of being permitted to participate in the Retreat, I knowingly, voluntarily and expressly waive any claim I may have against Jess Learoyd Yoga and staff and venue hosts for injury or damages that I may sustain as a result of participating in the retreat. I, my heirs and legal representatives forever release, waive, discharge and covenant not to sue Jess Learoyd Yoga for any injury or death caused by their negligence or other acts.

Jess Learoyd Yoga is confident that I will not find cause for concern during the retreat but if I have a problem during the retreat, I will inform the organiser immediately in private and they will endeavour to put things right. I am aware and know that Jess Learoyd Yoga and staff cannot be responsible for the individual behaviour of any group member or other guest sharing my accommodation. 

photography + videography

I, for good and valuable consideration, the receipt of which is hereby acknowledged, hereby irrevocably authorise Jess Learoyd Yoga (the company) to use photographs and videos of me and or my property and authorise her and her assignees, licensees, legal representatives and transferees to use and publish (with or without my name) photographs, pictures, portraits or images in any and all forms and media, and the purposes of publicity, illustration, commercial art, advertising, publishing (including publishing in electronic form on CDs or internet websites), for any product or services, or other lawful uses as may be determined by Jess Learoyd Yoga. I further waive any and all rights to review or approve any uses of the images, any written copy or finished product. I am of full legal age and have read and fully understand the terms of this release. 

If it is agreed on the event/retreat page, you may receive free images and videos from Jess Learoyd Yoga for your personal use and as memories of the event/retreat. 

If you do not want to be in any of the photos or videos, that is fine, but you must inform us in advance. 

extra information

I or my representative(s) agree to fully release and hold harmless Jess Learoyd Yoga (the company and all members of staff including hosting venue) from and against any and all claims or liability of whatsoever kind or nature arising out of or in connection with Jess Learoyd Yoga (the company and all members of staff).

I agree that I shall not in any way conduct myself inappropriately

I understand that I am free to withdraw from or reduce my participation in the activities, programs, and sessions at any time.

I acknowledge and understand that I am using the facilities at the Retreats at my own risk. In consideration for being permitted to participate in services, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the services offered and/or my presence at the premises at which Jess Learoyd Yoga's retreats operate.

This agreement is intended to constitute a complete release of any responsibility by releasees for personal injuries and/or property loss/damage sustained by me or anyone accompanying me, while attending the retreat, whether engaged in the offered services or not.

I agree to indemnify and hold releasees harmless from any and all liability and damages incurred arising out of my conduct or activity (or the conduct or activities of those for whom I am responsible) while attending the retreat or participating in offered services.

I understand that if I act in an inappropriate manner to anyone during the retreat, if I cause any inconveniences then I may be asked to leave the retreat and no compensation or refunds will be provided.

I have read and fully understand and agree to the above terms of this Liability Waiver Agreement. I am participating voluntarily and recognise that this serves as complete and unconditional release of all liability to the greatest extent. I acknowledge that Jess Learoyd accepts no responsibility for any potential injuries as a result of the practise.
